1. Acceptance of terms
By creating an account or using Daily Listen ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding legal agreement between you and Daily Listen, Inc.
2. Eligibility
You must be at least 13 years old to use Daily Listen. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
3. Description of service
Daily Listen is a news aggregation and AI narration service. We collect news from publicly available sources, summarize and narrate it using AI, and deliver it to you as an audio briefing. The content is for informational purposes only.
We do not guarantee the accuracy, completeness, or timeliness of news content. AI-generated summaries may contain errors or omissions. Always verify important information with primary sources.
4. Accounts
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.
5. Subscriptions and billing
Paid subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods.
We reserve the right to change pricing with 30 days' notice. If you do not accept the new pricing, you may cancel before the change takes effect.
6. Prohibited uses
You agree not to:
- Reproduce, redistribute, or resell Daily Listen content without permission
- Use the Service to train machine learning models
- Attempt to reverse-engineer or extract our AI models or pipelines
- Circumvent rate limits, access controls, or subscription restrictions
- Use the Service in a way that could harm, disable, or overburden our infrastructure
7. Intellectual property
Daily Listen and its licensors own all rights to the software, AI models, brand, and original content on the platform. News summaries are derived works; source news content is owned by its respective publishers and used in accordance with applicable fair use and aggregation principles.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILY COVERAGE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules.
11. Changes to terms
We may update these Terms. Material changes will be communicated by email at least 14 days in advance. Continued use of the Service after that date constitutes acceptance of the updated Terms.
